These Terms set forth the terms and conditions under which you may use the website, https://www.musictutoronline.com, and services offered. The website offers visitors Online Music Tutoring Services. By accessing or using the website or the service, you approve that you have read, understood, and agree to be bound by these Terms. If you disagree with any part of these terms you may not use the services of musictutoronline.com.

 

Key commercial terms offered to customers

When buying a tutoring service, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

 

The prices charged for using the tutoring services are listed on the website. MusicTutorOnline reserves the right to change the prices for services displayed at any time and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

 

Cancellation and Refund Policy for single hour €40 lessons

​

A minimum of 24 hours notice is required before a lesson if a client/student wants to cancel and get a refund. All cancellations must be done through e-mail communication by e-mailing info@musictutoronline.com.

​

If a client/student cancels 24 hours or more before a lesson, the client/student will be refunded the total amount, minus a €5,= administration fee.

If a client/student cancels the lesson less then 24 hours in advance, no refund can be given. 

Please inform musictutoronline in case of canceling by emailing info@musictutoronline.com.

At no time can a refund be given for lessons that have already taken place.

Cancellation and Refund Policy for all membership lesson packages and courses.

​

A minimum of 24 hours notice is required before the first scheduled lesson if a client/student wants to cancel and get a full refund. All cancellations must be done through e-mail communication by e-mailing info@musictutoronline.com.

If a client/student cancels a membership lesson package or a course, 24 hours or more before the first lesson has taken place, the client/student will receive a full refund, minus a €10,= administration fee. 

If a client/student cancels a membership lesson package or a course less than 24 hours before the first-hour lesson has taken place, the client/student will receive a full refund, minus the price for one lesson, and minus a €10 administration fee.

Membership lesson packages and courses canceled at any time after the first lesson has taken place, can not be refunded. Exceptions may be made only in cases in which a student cannot attend due to serious illness or the death of an immediate member of the student’s family.  In these cases, official documentation may be required.

At no time can a refund be given for lessons that have already taken place.

Rescheduling Policy

​

All rescheduling requests must be done through email communication at info@musictutoronline.com.

​

Lessons can be re-scheduled through email communication and are depending on availability and have to be scheduled within the time validity of the purchased membership lesson package or course. Single-hour €40 lessons have a validity of 1 month from the date of purchase. For membership lesson packages and courses the validity is stated on the website and will be communicated through email before purchasing and confirmed again after payment.  Time validity is also always stated in the confirmation emails.

To re-schedule please send an e-mail at least 24 hours in advance to info@musictutoronline.com and MusicTutorOnline will get in touch with you to find a new suitable date for you. 

 

It is not possible to re-schedule a lesson less than 24 hours in advance. If you fail to re-schedule your lesson with less then 24 hours notice, and don't attend that session, then that will be seen as a missed lesson, and no rescheduling is allowed for missed lessons.

Cancellations of lessons by MusicTutorOnline

​

MusicTutorOnline has the right to cancel lessons by giving 24 hours prior notice to the client/student in which case no fees shall be incurred. MusicTutorOnline shall reschedule the appointment at a time agreeable to both parties. If no agreeable reschedule time can be found, the client/student shall be refunded for the missed lesson fee and no administrative fees will be collected in such a case.

Late arrival for the lesson

​

Fees are calculated according to the times stipulated in the schedule and no adjustment shall be made for time lost because of late arrival by the student. Students who arrive late will only be tutored for the remainder of the scheduled session. There will be no prolonged sessions.

​

Any lost time because of the late arrival of MusicTutorOnline shall be compensated for by extending a lesson by mutual agreement and by such amount of time that was lost.

​

No-Show Policy

​

MusicTutorOnline will wait for 15 minutes into the lesson time in case the student is late.  If a student is late for more than 15 minutes, this will be considered as no-show. No discount or refunds shall be given for student no-show lessons. Student no-show lessons can not be rescheduled. 

​

If MusicTutorOnline causes a no-show, a new lesson time will be rescheduled at a time agreeable to both parties, or if no agreeable reschedule time can be found, the client/student shall be refunded for the lesson and no administrative fees will be collected. 

​

Retention of right to change offering

 

MusicTutorOnline may, without prior notice, change the Services; stop providing the services or any features of the services offered, or create limits for the services. MusicTutorOnline may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason. 

​

Obligations of the Student

​

The Student undertakes to assist the Tutor in identifying problem areas in which the Student needs specific tutoring.

The Student agrees to be prepared for every session by having all materials, utensils, homework, etc. ready and available in the designated tutoring location prior to the start of the online tutoring lessons. 

The Student agrees that assignments, exercises, or homework form an integral part of tutoring and undertakes to complete such work timely.

Obligations of the Parent/Guardian

​

The parent/guardian undertakes to be responsible for the student’s conduct and character during the tutoring sessions including promptness, respectful behavior, and staying on task.

The parent/guardian is responsible for initiating any communication with the tutor.

The parent/guardian is responsible for getting the student online on time.

The parent/guardian agrees to ensure that the student has completed all work assigned by the tutor within the timeframe given.

 

Ownership of intellectual property, copyrights, and logos

 

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of MusicTutorOnline. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text, and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed on the website.

 

What are the requirements to get a student environment login?

 

The student environment is currently not in use. 

 

Right to suspend or cancel student environment account

 

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to paid memberships and courses, such memberships and courses will be discontinued only upon the expiration of the respective period for which you have already made payment.

 

Indemnification

 

You agree to indemnify and hold MusicTutorOnline harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

Limitation of liability

 

To the maximum extent permitted by applicable law, in no event shall MusicTutorOnline, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. 

 

To the maximum extent permitted by applicable law, MusicTutorOnline assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

Right to change and modify Terms

 

MusicTutorOnline reserves the right to modify these terms from time to time at MusicTutorOnline's sole discretion. Therefore, you should review this page periodically. When MusicTutorOnline changes the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

 

Promotional emails and content

 

You agree to receive from time to time promotional messages and materials from MusicTutorOnline, by mail, email, or any other contact form you may provide MusicTutorOnline with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify MusicTutorOnline at any time by emailing at info@musictutoronline.com.

 

Preference of law and dispute resolution

 

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of The Netherlands, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in The Hague. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

Provisions for user communities on our website https://www.musictutoronline.com and the MusicTutorOnline Wix app

 

MusicTutorOnline offers its users the ability to create communities for the users of their musictutoronline.com website and their MusicTutorOnline Wix app, in order to interact with such users in a better way.  

 

The website and app include a user community, MusicTutorOnline likes to state that all users that join a community have a public profile that is publicly visible to site visitors, and that their public activity (such as their posts or comments) will be visible to other visitors of the website.

 

It is important to note, that a user of our musictutoronline.com website can always opt-out and exit the community, and upon doing so, such a user’s profile will no longer be publicly visible. Naturally, in such an event the user will not be able to use the community features (e.g. liking, commenting, or writing posts).
